The ATO applies four residency tests, and you are a resident if you meet any one of them: the resides test (do you live in Australia by ordinary concepts — home, family, work, assets), the domicile test, the 183-day test, and the Commonwealth superannuation test for certain government employees. For nomads the domicile test is the trap. Your domicile stays Australian until you establish a permanent place of abode somewhere else, and the leading Harding case makes clear that drifting between countries with no fixed or habitual home overseas does not qualify. A perpetual traveller can remain an Australian tax resident, liable on worldwide income, however few days they spend in Australia. To genuinely cease residency you need a durable home abroad and severed ties. Doing so triggers CGT event I1: you are deemed to have disposed of your assets, excluding Australian real property, at market value on the day you stop being a resident, so unrealised gains crystallise then — though you can elect to defer the tax until you actually sell. Superannuation is not deemed disposed of, but it stays locked: you cannot access it until you reach preservation age (60) and meet a condition of release, wherever you live, and non-residents generally cannot contribute the usual way. Two more catch people. The CGT main-residence exemption is largely removed for non-residents who sell an Australian home, so a former principal residence can become fully taxable. And a HELP or HECS study debt keeps being indexed and must be reported and repaid against your worldwide income while you are overseas. Choose Europe for the lifestyle and the residency pathway, choose Asia when staying in sync with home matters more than the address.
Cease residency deliberately, or not at all
The worst outcome is being half-out: living abroad but still an Australian tax resident because you never established a permanent home elsewhere. That leaves you taxable on worldwide income in Australia and possibly taxed again locally. If you mean to leave the tax system, do it properly — sign a real lease abroad, move your economic centre, and cut Australian ties so you clear the domicile test rather than drifting.
For some nomads, the cleaner choice is the opposite: stay an Australian tax resident on purpose. If you keep a home and strong ties in Australia and move around a lot, trying to be non-resident may fail anyway and invite CGT event I1. Staying resident keeps your affairs simple and your super and franking benefits intact — a legitimate strategy if you are not committed to a genuine base overseas.
